Back in 2023, Marine veteran Daniel Penny restrained in a chokehold a fellow New York City Subway rider who had grown agitated and was threatening the lives of other passengers saying “I’ll kill you all and I don’t care if go to prison.” Neely passed away in the aftermath of this event and Penny was charged with manslaughter and criminally negligent homicide. I wrote about it at the time.
As that case was being deliberated last week, the ideology of the Assistant District Attorney who’s prosecuting him raised some eyebrows.
This prosecutor who opted to charge Daniel Penny is a lesbian “married” to a Peruvian feminist activist artist, known for promoting the ideal of “equity” and supporting movements like Black Lives Matter. Video posted to X features Assistant DA Dafna Yoran explaining how in a recent case she had been lenient to a young man who had committed armed robbery and unintentionally killed a man. In the video, she explains that, “under the law, this is a felony murder, which is akin to intentional murder,” but “the more [she] learned about the defendant” … she “really felt incredibly sorry for him that he had got to that point that he felt there was no other choice but to commit this robbery.” That case actually sounds similar in that both deaths were unintentional, so why did she decide to prosecute Daniel Penny? Well, that perpetrator was black, whereas Daniel Penny is, as she apparently has been referring to him in the trial is “the white man.”
If the prosecutor got her way, this young man would have been put behind bars for protecting his fellow subway passengers, while an armed robber she felt sorry for got away with murder, and with all of this context in mind, many of us would have been left assuming that he was prosecuted and convicted because of his race.
Thankfully, that did not happen. Last week, Penny’s manslaughter charge was dismissed by a hung jury, and today, he was found “not guilty” of negligent homicide.
In the piece I wrote last year on Daniel Penny, I contrasted him with another soldier who was in the news for his penchant for performing as a drag queen. I asked: “What will our society celebrate? A veteran who steps in to protect his fellow passengers from a belligerent, mentally ill homeless man, even one with a tragic backstory? Or will we celebrate a gender-bending deviant soldier who seeks to entertain his fellow soldiers by stripping for them?
“These two soldiers present contrasting visions of the ideal military, or even civilian, man. Which will prevail in our society?”
What’s amazing and encouraging is that our society actually seems to be making the right choice these last few months. The November election was a resounding rejection of “woke” ideology. “Pride Month” this year was the straightest it’s been in a decade, at least as far as major corporations are concerned. And, now a jury in the liberal stronghold of New York City have chosen the side of true justice against the cajoling of a social justice warrior Assistant District Attorney.
Of course, Christians know that for America to be made “great” again, we will have to turn to God again. But even there, as my associate Lisa Van Houten wrote last week, we find good news as Bible sales are up 22% this year!
May God continue to be merciful to our country, in allowing us to turn away from stupid and wicked ideologies which have held our country in their sway and thank God for justice for Daniel Penny!
