Courageous States and a Cowardly Congress (Part 2)

Tuesday, we brought to your attention the eleven courageous states that are willing to stand for common sense, decency, and against the tyrannical federal overreach of our current administration. We encouraged our readers to pray that more states would also stand in the gap for the privacy and safety of our young people. If we will neither boldly protect our children from this lunacy nor fight perseveringly to keep our state sovereignty, all is lost—and deservedly so. (To read Tuesday’s article click here.)

In addition to the 11 states suing the Obama administration, other state attorneys general are also speaking up.  Michigan AG Bill Schuette called the federal decree  “another prime example of federal overreach“ and in writing to U.S. Attorney General Loretta Lynch and Secretary of Education John King, stated:  “… ignoring the essential role of parents, local school teachers and administrators, and done without the debate and consent of the legislative branch — is a failing that needs to be corrected.”

And Ohio AG Mike DeWine also warned the Obama administration:  "There are many questions that, consistent with constitutional guarantees, are best left to the fair-minded, sensible determinations of our local communities. Under our system of government, how schools work to handle locker room questions involving students' gender identity is one such issue. If the Obama administration takes action to remove these decisions from Ohio parents and local schools, I will vigorously fight against such overreach."

As DeWine also pointed out:  "Congress has not changed the law — and no 'guidance' from federal officials can do what Congress has declined to do."

Yet as the Obama administration has lawlessly wrested away the power that constitutionally belongs to Congress, Congress has done nothing more than lawlessly “rest.”  For the most part, our senators and representatives are meekly silent as their authority is undermined.  If it wasn’t for the action taken by states, the Obama administration’s tyrannical actions would stand unchallenged. 

As Tony Perkins, of Family Research Council, wrote: “… Congress can and should use the constitutional power of the purse as a check on a runaway administration. But, for reasons unknown to anyone with political sense, the GOP missed the opportunity to crack down on the president's lunacy. It raises the question: if the Republicans won't stand up and challenge the president on a policy this outrageous, what will they fight for?”

The most egregious example of this Congressional cowardice has come from none other than the North Carolina senior Republican Senator, Richard Burr. 

Senator Burr’s home state of North Carolina has been in the crosshairs of the Obama administration over their commonsense bathroom law.  As North Carolina has been under attack from every leftist front, Republican Senator Burr threw his state under the proverbial bus.  As you can read here,not only did Senator Burr abdicate his responsibility, declaring “Congress should defer to the courts” on the transgender bathroom issue, but he is also now indicating his opposition to the North Carolina law passed overwhelmingly by his fellow state Republicans. 

Another Congressional seat from North Carolina, junior senator Thom Tillis, also stands against his state by refusing to pushback against federal overreach or judicial lawlessness. Daniel Horowitz, of the Conservative Review, reports:  “…how can Tillis suggest that he will wash his hands of HB2 because it’s a state issue?  Yes, that’s the point. It was a state issue until the two unelected branches of the federal government (DOJ and Fourth Circuit Court of Appeals) made it a federal issue.  Why won’t the representatives from North Carolina in the elected branch of the federal government help return the issue to the states?  Moreover, eradicating gender differences is neither a state nor a federal issue; it is reflective of mental illness and de-civilization.” You can read the whole article here.

It’s time to remove the crosshairs off from those states that are standing boldly. Now, turn the heat up on those elected men and women of Congress who are supposed to be representing the people of their state. Those who have won their seat by misrepresenting themselves as conservative runners, now showing their liberalness, and voting against those who trustingly put them there, need to be reminded that they work for the people.

The recent directive from the federal Departments of Education and Justice under President Obama requiring local schools to implement transgender policies is offensive, intrusive, and completely lacking in common sense.

Officials in numerous states have been quick to push back against this federal overreach – but you have not.  Instead, as the Obama administration has usurped the authority of Congress, you wrongly and outrageously claimed it was a “judicial matter.”

The American people deserve representatives who will protect and defend their individual liberty and the sovereignty of states – not abdicate that duty.

Your words and lack of action betray the values of the voters who elected you.  I strongly urge you to take action to protect our children and stop the Obama administration’s radical overreach.
