Our summmer conference is coming up in three days!!! I ask 3 questions of one of our presenters – Pat Trueman, (http://pattrueman.com/) former head of the Child Exploitation and Obscenity Enforcement Section in Washington DC – including “Have the pornographers won?”
Pat answers three basic questions starting with the following:
#1 Question:Â During your years of serving as head of the Child Exploitation and Obscenity Enforcement Section at Justice, name one thing that particularly stands out that you have learned about the pornography industry?
ANSWER:
The entire porn industry knows it is violating federal law but relies on weak prosecutors or prosecutors who don’t want to see obscenity laws enforced to thrive. A relative few well placed prosecutions would kill the porn industry.

#2 Question: Years ago you made a statement (after leaving your post) that went something like this “The battle is over. The pornographers have won.” Did you really mean what it sounds like? And, after even more years, “Have the pornographers won?”
ANSWER: I made that statement after Bill Clinton became president and his attorney general, Janet Reno, stopped prosecution of obscenity. Take a look around America today and you will see that pornographers have won.
#3 Question: Does pornography have to be fought from the top on down as opposed to the bottom up? Please explain.
ANSWER: The best legal approach to attacking the porn industry is to have the U.S. Department of Justice prosecute the major producers and distributors of obscenity. That means prosecute the cable/satellite companies that offer porn, the major hotels/motels that offer porn, the major web sites promoters of porn, etc. Vigilant state prosecutors should go after local pornography shops. However, libertarians and liberals do not believe in restricting illegal pornography even though sufficient laws are on the books to eliminate trade in most material. Thus we are awash in pornography.
